I agree with Desi, as long as it is a "normal" level and type of trading. Previous discussion on the subject has suggested that it can become a grey area if your activity and types of transactions would class you as a "day trader".

This can be considered self employment. Here are a couple of links on the subject of "day trading". Day trading is not a passive investment, you are actively engaged in making decisions every day and spend significant amount of time. I am sure if you google the interwebs, you can find some references. That said, you need to figure out if your are a Day trader based on SEC rules or USCIS passive investor rules. SEC has a more restrictive rule that if you filp a few stocks within a day period, you are a day trader.

I don't agree with that. Day trading is not a full time activity. But for God sake opening and closing 4 times in 5 days wouldn't take 5 full days of work. You don't have to be in US to invest in US stocks. You can trade US stocks from India if India let you do it. I am trading stocks and options since last 8 years and i also own real estate my home since more than an year and half.

I am still on H1 - 9 th year. I was classified as pattern day trader couple of times by my broker scottrade. The only issue is you need to maintain at least 25K in your account if you are classified as pattern day trader. Meaning you could be buying today and selling it tomorrow and still be a day trader. However, please learn the uncle sam rules very well before you plunge into day trading in us.

Day trading in not illegal. Buffet is a full time investor. Likewise, day trading is not equal to trader's job. Traders do require a license to perform their duty whereas you and me don't require any license to do day trading.

Above all, day trading by anyone is not illegal. In fact H1B can do options trading too It is not equal to the las vegas gambler job.

But going back to my initial post in this thread, I would like to remind people that there are differences in the definition of day trader based on what SEC sees and what IRS and consequently USCIS sees.

For SEC, any 4 flips within 5 days period marks the person as a pattern day trader, which imposes a 25K margin account balance requirement.

For IRS and USCIS , a day trader is someone who has done significant amount of stock trades in a year s of transaction. You should look at the rules from IRS which allows a person to classify self as a day trader and hence deduct expenses related to that like subscription to business journals etc.

Now, given advances in technology as Pyrenees claims, it is possible to be trading daily without much interaction. I doubt it is really a fire and forget system, if I knew about those things I wouldn't be spending time in this forum, but it is probably sufficient enough to calm USCIS' concerns. You need to discus this with your lawyer. My opinion is that this is not even an immigration issue but a tax issue.

You are in here for H1B approved job not for doing fulltime day trading business. Nope dependent cant do it either. Again casual trading is allowed, but day trading is disallowed even for H4 dependents. L2 can definitely do whatever they want to.
